Terms of Service

1. General

- By purchasing my artwork, adoptables, or commissions, you agree to these Terms of Service.- The Terms of Service in effect at the time of purchase apply to your order.- Violation of these Terms may result in revocation of usage rights and refusal of future service.

2. Right to Refuse Service

- I reserve the right to decline any commission request before payment is made.- I may decline requests that are outside my comfort zone, skill level, or schedule.

3. Payment

- Full payment is required before work begins unless otherwise agreed.- Payments are accepted only through my available payment methods.- Prices are listed in USD unless otherwise stated.- Work will not begin until payment has been received.

4. Refund Policy

- Full refunds are available only if work has not started.- Partial refunds may be issued depending on the amount of work completed.- No refunds are available after the artwork has been completed or delivered.

5. Turnaround Time

- Estimated completion time varies depending on workload and complexity.- Delays may occur due to illness, emergencies, or personal circumstances.- Clients will be informed of significant delays whenever possible.

6. Revisions

- Minor revisions during the sketch stage are free.- Major design changes after approval may incur additional fees.- Revisions requested after completion may require extra payment.

7. Client Responsibilities

- The client must provide clear references and accurate information.- Delays caused by missing information or lack of communication are the client's responsibility.

8. Copyright

- I retain full copyright ownership of all artwork unless Commercial Rights are explicitly purchased.- Purchasing artwork does not transfer copyright ownership unless stated otherwise.- If Commercial Rights are purchased, the client receives full commercial usage rights for the purchased artwork or adoptable as outlined in the agreement.

9. Commercial Use

Commercial Rights are NOT included unless explicitly purchased.Commercial use includes, but is not limited to:
- Merchandise
- Prints for sale
- Books
- Games
- Visual novels
- Branding
- Streaming assets
- Advertising
- Promotional materialCommercial Rights may require an additional fee.

10. AI / Machine Learning

My artwork may NOT be:- Used for AI training.
- Uploaded into AI generators.
- Used as datasets.
- Used for image generation or machine learning.
- Used to create derivative AI-generated works.

11. NFT / Blockchain

My artwork may NOT be:- Minted as NFTs.
- Uploaded to blockchain platforms.
- Sold as digital tokens.
- Used in Web3 projects without written permission.

12. Editing

Clients may:- Crop images.
- Resize images.
- Add simple text.
- Create personal edits.Clients may NOT:- Remove my watermark or signature without permission.
- Claim the artwork as their own.
- Trace or heavily edit the artwork to conceal authorship.

13. Credit

Whenever reasonable, credit should be given to me as the original artist when reposting or displaying the artwork online.

14. Adoptables

Unless otherwise stated, owners may:- Rename the character.
- Change gender or pronouns.
- Modify personality.
- Create lore.
- Redesign the character.
- Commission additional artwork.
- Gift the character.
- Trade the character.Owners may NOT:- Claim to be the original creator.
- Sell copies of the design.
- Redistribute the original files.
- Use the design for AI or NFTs.

15. Reselling

- Characters may be resold only if Commercial Rights were purchased.- Proof of ownership should be transferred with the character.

16. File Delivery

- Final files are provided in the agreed format.- Source files (PSD, Clip Studio, etc.) are not included unless specifically purchased.

17. Portfolio Rights

I reserve the right to:- Display the artwork in my portfolio.
- Post it on social media.
- Use it for self-promotion.
- Include it in commission or adoptable galleries.

18. Confidentiality

Private commissions or delayed public posting may be arranged upon request before work begins.

19. Chargebacks

- Unauthorized chargebacks will be considered a violation of these Terms.- I reserve the right to revoke usage rights and blacklist future commissions.

20. Liability

- I am not responsible for misuse of the artwork after delivery.- The client is responsible for ensuring that their intended use complies with local laws and platform policies.

21. Acceptance

Purchasing my artwork indicates that you have read, understood, and agreed to these Terms of Service.
